FreshWebCanvas ("we", "us", "our") respects your privacy and is committed to protecting personal data in accordance with Regulation (EU) 2016/679 (GDPR).

1.1 Data Controller. The data controller is FreshWebCanvas, ul. Wojska Polskiego 45, 70-473 Szczecin, Poland. Contact: [email protected].

1.2 Data Collected. We collect only the personal information you voluntarily provide through our contact forms: name, email address, phone number, company name, and project details.

1.3 Purpose of Processing. Your data is processed exclusively for: (a) responding to your inquiry; (b) preparing project proposals; (c) delivering contracted services; (d) fulfilling legal and tax obligations.

1.4 Data Retention. Contact form data is retained for 24 months after the last communication. Contract-related data is retained for the duration of the contract plus 5 years as required by Polish tax law.

1.5 Third-Party Disclosure. We do not sell, rent, or share personal data with third-party marketers. Data may be shared with: hosting providers (EU-based), payment processors (Stripe), and accounting services as required by law.

1.6 Your Rights. Under GDPR you have the right to: access your data, rectify inaccuracies, request erasure, restrict processing, data portability, and lodge a complaint with the Polish Data Protection Authority (UODO).

2.1 Scope. These Terms govern all services provided by FreshWebCanvas including web design, UI/UX development, brand identity, and related digital services.

2.2 Proposals & Contracts. A project begins upon mutual acceptance of a written proposal or statement of work (SOW). Proposals are valid for 30 days from date of issue.

2.3 Payment Terms. Projects require a 50% deposit before work commences. The remaining 50% is due upon project completion and before final file delivery. Invoices are payable within 14 days.

2.4 Intellectual Property. Upon full payment, all intellectual property rights to deliverables (designs, code, assets) are transferred to the client. FreshWebCanvas retains the right to display work in portfolios unless otherwise agreed.

2.5 Revisions. Each project includes up to 2 rounds of revisions as specified in the SOW. Additional revisions are billed at €75/hour.

2.6 Timeline. Project timelines are estimated in business days. Delays caused by client feedback or content delivery will extend the timeline proportionally. FreshWebCanvas is not liable for delays caused by third-party services.

2.7 Limitation of Liability. FreshWebCanvas's total liability shall not exceed the total fees paid by the client under the applicable SOW. We are not liable for indirect, consequential, or incidental damages.

3.1 What Are Cookies. Cookies are small text files placed on your device when you visit our website. They help us recognize your browser and remember certain preferences.

3.2 Cookies We Use. We use only essential functional cookies for: (a) session persistence; (b) cookie consent preference storage. We do not use analytics, advertising, or third-party tracking cookies.

3.3 Consent. Upon your first visit, a cookie consent banner is displayed. Clicking "Accept" stores your consent in localStorage. You may clear this at any time via your browser settings.

3.4 Managing Cookies. You can control and delete cookies through your browser settings. Disabling essential cookies may affect site functionality.

4.1 Deposit Refund. The 50% project deposit is fully refundable if cancelled before any design or development work has commenced.

4.2 Partial Refund. If a project is cancelled after work has begun, the client is entitled to a partial refund proportional to the work not yet completed, at FreshWebCanvas's reasonable discretion.

4.3 Completed Work. No refund is available for completed and delivered work. Once final deliverables are accepted and the balance is paid, the engagement is considered fulfilled.

4.4 Request Process. Refund requests must be submitted in writing to [email protected] within 14 days of the relevant invoice date.
